Former Nike CD-78, Restoration Advisory Board (RAB) Decision The purpose of this notice is to inform the public that the U.S. Army Corps of Engineers (USACE) recently assessed community interest in establishing a Restoration Advisory Board (RAB) at the Formerly Used Defense Site (FUDS) Nike CD-78 Missile site in Oxford, OH. According to the Department of Defense RAB Rule published in 32 CFR Part 202, the Office of the Secretary of Defense (OSD) Restoration Advisory Board Rule Handbook (March 2007), and Department of Army Engineer Pamphlet (EP) 200-3-1, USACE assesses community interest in establishing a RAB at FUDS properties every two years if environmental restoration activities are ongoing. The assessment included consultation with the local community, Tribal Nations, and other stakeholders as appropriate, followed by a 30-day public comment period. Where USACE has determined a FUDS site warrants remedial action, a RAB may be established to provide for active community involvement in the site restoration process. Due to the nature of the responses received from a public notice published in February 2023, and subsequent feedback, the USACE Louisville District Commander has concluded there is not sufficient and sustained community interest in forming a RAB for the FUDS Nike CD-78 property at this time, based on the criteria established in the RAB Rule Handbook. A Memorandum for Record signed on August 11, 2023 documenting this decision will be part of the Administrative Record. In accordance with the Department of Defense RAB Rule, the district will re- evaluate community interest in forming a RAB at this property again in two years if environmental restoration activities are still ongoing.
