Ph: 614-644-3037 email: HClerk@epa.ohio.gov Notice of Receipt of 401 Application ODOT - Proposed Regional General Permit Facility Description: 404 and 401 Clean Water Act Receiving Water: Surface Waters of the State ID #: DSW401196196 Date of Action: 04/22/2019 Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA) Division of Surface Water (DSW) has received an application for and has begun to review the proposed Regional General Permit (RGP) For The Ohio Department Of Transportation, as announced in the U.S. Army Corps of Engineers Public Notice (No. 200800689) on February 15, 2019. The RGP would be solely for Ohio Department of Transportation use, and would authorize revised versions of the following three Nationwide Permits formerly certified by Ohio EPA, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Sections 404 and 401 of the Clean Water Act: A. Linear Transportation Projects (NWP 14) B. Maintenance Activities (NWP 3) C. Bank Stabilization (NWP 13) The application for authorization of the Regional General Permit was submitted by the U.S. Army Corps of Engineers, Huntington District, 3990 E Broad St, Building 10/Section 10, Columbus, Ohio, 43218-3990. The discharges from the activities, if approved, would result in degradation to, or lowering of, the water quality of surface waters of the state, including wetlands, streams, and lakes. In accordance with OAC Rule 3745-1-05, an antidegradation review of the application will be conducted. No exclusions or waivers, as outlined by OAC Rule 3745-1-05, apply or may be granted. Starting DATE OF PUBLICATION, copies of the February 15, 2019 proposed RGP and Public Notice may be inspected on the Ohio EPA-DSW website: www.epa.ohio.gov/dswwww.epa.ohio.gov/dsw.gov Ohio EPA will hold a public information session and public hearing relative to the issues of lower water quality at 3:00 p.m. on June 12, 2019 at the Ohio EPA Central Office, 6th floor Summer (B) conference room, 50 W Town St. Columbus, Ohio 43216. The public hearing will end when all interested parties have had an opportunity to provide testimony related to the RGP. All interested persons are entitled to attend or be represented and give written or oral comments on the proposed RGP. The purpose of the hearing is to obtain additional information that will be considered by Ohio EPA prior to any further action on the proposed RGP. Ohio EPA will continue to accept written comments on the proposed RGP through the close of business on June 19, 2019. Comments received after this date may not be considered as part of the official record of the hearing.
