Perry To: Byron Marciano Perry, whose last known address was 240 Audubon Park, Dayton, Ohio, whose current place of residence and whereabouts are unknown and cannot with reasonable diligence be ascertained, will take notice that on October 20th, 2023, Tiffany Shevere White filed a Petition for the Termination of the Parental Rights of Byron M. Perry for Aniya Evon White whose DOB is 6/14/2007. The Minnesota State District Court, located at the Anoka County Courthouse, 2100 3rd Avenue, Anoka, MN 55303-2489 will hold an admit/deny hearing on the 18th day of December, 2023 at 8:30 a.m. It is alleged in the petition, pursuant to MN Stat. Sec. 260C.301 Subd.1.(b)(1), that Byron M. Perry, the Respondent, has abandoned the minor child A.E.W., as defined by MN Stat. Sec. 260C.301 Subd.2.(a) Abandonment is presumed when(1) the parent has had no contact with the child on a regular basis and not demonstrated consistent interest in the child's well-being for six months and the social services agency has made reasonable efforts to facilitate contact, unless the parent establishes that an extreme financial or physical hardship or treatment for mental disability or chemical dependency or other good cause prevented the parent from making contact with the child. This presumption does not apply to children whose custody has been determined under chapter 257 or 518. The minor child's biological and legal mother, Tiffany S. White, the Petitioner, wishes to pursue an adoption for the minor child by the minor child's step-father, Ashley White, the father of the minor child's biological sister. If the Respondent will not give his consent to the adoption of the minor child, the Petitioner must petition for the termination of the Respondent's parental rights. A parent who consents to the termination of parental rights under the provisions of section 260C.301, subdivision 1, clause (a), may waive in writing the notice required by the subdivision; however if the parent is a minor or incompetent the waiver shall be effective only if the parent's guardian ad litem concurs in writing. 11-15, 11-22, 11-29/2023
