WARREN COUNTY COMBINED HEALTH DISTRICT REGULATION FOR THE INSTALLATION, MAINTENANCE, TESTING AND INSPECTION OF PLUMBING THESE REGULATIONS ARE FOR THE PURPOSE OF ESTABLISHING STANDARDS GOVERNING THE INSTALLATION, MAINTENANCE, TESTING AND INSPECTION OF ALL PLUMBING; ESTABLISHING PLUMBING REGULATIONS AND THEIR ENFORCEMENT AS A LOCAL REGULATION; REQUIRING A REGISTRATION OF PERSONS ENGAGED IN THE PLUMBING BUSINESS; REQUIRING PERMITS FOR PLUMBING WORK IN ORDER TO PROTECT THE PUBLIC HEALTH AND WELFARE, TO PREVENT THE CONTAMINATION OF WATER SUPPLIES, AND TO PROVIDE FOR THE SANITARY COLLECTION OF WASTES. THEREFORE, BE IT RESOLVED BY THE BOARD OF HEALTH OF THE WARREN COUNTY COMBINED HEALTH DISTRICT (TO BE SUBSEQUENTLY REFERRED TO AS WARREN COUNTY HEALTH DISTRICT) TO ADOPT. SECTION 1 - Definitions The following definitions apply in the interpretation and enforcement of these regulations: 1.1 Dwelling means any building which is wholly or partly used or intended to be used by human occupants not included in Section 3781.06 of the Ohio Revised Code, and includes any single-family, two-family, or three-family dwelling. 1.2 Health Commissioner means the legally designated health commissioner of the Warren County Combined Health District or their authorized representative. 1.3 Person means and includes any individual associated with any firm, corporation, business, or partnership engaged in plumbing activity. 1.4 Contracting Plumber means one who is registered and bonded and is responsible for permits and inspections. 1.5 Installing Plumber means one who is registered to install plumbing for a contracting plumber. SECTION 2 - Plumbing for Dwellings 2.1 All plumbing in dwellings in Warren County shall be installed, maintained, and inspected in accordance with Chapter 4101: 2-56-69 of the Ohio Administrative Code as adopted by the Board of Building Standards pursuant to Section 3781.10 of the Ohio Revised Code, and any amendments or additions thereto. SECTION 3 - Registration of Person Engaged in Plumbing 3.1 The health commissioner shall maintain a register of all installing and contracting plumbers engaged in or intending to engage in plumbing within Warren County. At least one registered plumber shall be present at and responsible for each plumbing installation unless other-wise stated in this regulation. 3.2 Any person engaged in or intending to engage in plumbing shall make application to the health commissioner, on a form provided by the health commissioner, to have their name placed on the register for those engaged in plumbing. The application form shall contain the name and address of the person making application and the name and address of the firm or place of business they are associated with, and such other information as the health commissioner determines will reasonably aid in the administration and enforcement of these regulations. 3.3 After adoption of this regulation, any person making application to have their name placed on the register for those engaged in plumbing shall submit with such application a fee as established by resolution by the Warren County Board of Health. 3.4 Upon acceptance of a prospective applicant's registration as a contracting plumber, registrant shall post a surety bond with the Warren County Health District, in the sum established by the Warren County Board of Health in favor of Warren County, conditioned upon registrant's faithful compliance with rules and regulations, relating to plumbing, which may from time to time be established by the Warren County Health District. 3.5 Upon recommendation of the health commissioner, the Board of Health may remove the name of any person from the register of persons registered to do plumbing who has demonstrated inability or unwillingness to comply with these regulations and Chapter 4101: 2-56-69 of the Ohio Administration code. Such person shall have their name reinstated on the register of persons engaged in plumbing, by the Board of Health, after satisfactory demonstration of ability and willingness to comply with these regulations and Chapter 4101: 2-56-69 of the Ohio Administrative Code. SECTION 4 - Permit Required, Fee, Re-Inspection Fee 4.1 No plumbing shall be done in Warren County, except in cases of leaks or repairs in existing plumbing, until a permit has been obtained from the health commissioner. 4.2 An application for a permit to do plumbing work must be made, on forms provided by the health commissioner, including a full set of isometric drawings on the back of the form or on separate sheet(s), prior to the expected time of starting the plumbing work. Failure to secure a permit before work is started may result in a double fee charge. 4.3 A plumbing permit is valid for the period of twenty-four (24) months from the date of issuance. a. A one-time permit extension may be granted by the health commissioner or their designee for an additional six (6) months upon written request from the property owner or their agent for a total of thirty (30) months from the date of issuance. The request must be made at least seven (7) days prior to permit expiration. 4.4 The plumbing department may grant a variance from the requirement for an isometric drawing in the case of a small alteration, setting a fixture or water heater. The plumber shall request this variance at the time of application for the permit. 4.5 Each application for a permit to do plumbing shall be accompanied by a fee as established by the Warren County Board of Health. 4.6 Any person doing plumbing who is hired to complete work on a permitted job shall obtain another permit in the name of the person assuming responsibility to complete installation of the plumbing. The permit fee shall be the cost of the initial permit. 4.7 No permit shall be issued to any person to do plumbing whose name is not on the register, maintained by the health commissioner, as a contracting plumber, as provided in Section 3 of this regulation, except to the owner of a single-family dwelling to personally perform the work in the house in which they live or in which they intend to live. 4.8 A re-inspection fee as established by the Warren County Board of Health may be charged for any re-inspection required because of plumbing work being found as unacceptable. 4.9 A home owner may do plumbing work within the home in which they live, or intends to live. If final approval is not secured within two years, the home owner shall have to re-apply for their permit with the Warren County Health District. SECTION 5 - Penalties 5.1 Any person who violates any provision of these regulations shall be in violation of Section 3709.21 and subject to the penalties provided by Section 3709.99 of the Ohio Revised Code. SECTION 6 - Effect of Partial Invalidity 6.1 Should any part of these regulations be declared unconstitutional for any reason; the remainder of these regulations shall not be affected thereby.
