NOTICE OF PUBLIC HEARING Public notice is hereby given that the Board of County Commissioners of Butler County, Ohio, will conduct a hearing to consider all evidence presented concerning the amount of the estimated assessments to provide funds for the maintenance of the Storm Water Management System (the "Ditch") for land located in Section 34, Township 3, Range 3, M.Rs., Liberty Township, which certain landowners in Butler County have proposed to be constructed on their property pursuant to their agreement filed with the Clerk of said Board of County Commissioners on June 27, 2019. Said ditch will be constructed in the following location: Description: Ditch Petition Legal Description for Windsor Estates, Sec. 6 & 7 Location: Liberty Township 49.998 Acre Tract Situate in Section 34, Township 3, Range 3, M.Rs., Liberty Township, Butler County, Ohio and being all of the lands platted as Windsor Estates Section 6, as recorded in Plat Envelope 9123, Pages 725-727, and all of Windsor Estates, Section 7 (not yet recorded, and being all of Lot 1 and Lot 2 as shown on Survey Volume 59, Page 68, (All references to deed books, plats or survey records made hereon are recorded in the office of the Butler County Recorder located in Hamilton, Ohio) and being more particularly described as follows: Beginning at a set 5/8" iron pin the southeasterly corner of Lot 178 of Windsor Estates Section Four, as recorded in Plat Envelope 8854, Page 1434, and on the northerly right-of-way line of Bryson Lane; Thence along the easterly line of said Lot 178, North 05degrees 59minutes 03seconds East, a distance of 153.17 feet to a set 5/8" iron pin on the southerly line of Lot 233 of Windsor Estates Section Five, as recorded in Plat Envelope 8963, Page 172; Thence along the southerly line of said Lot 233, South 84degrees 00minutes 57seconds East, a distance of 180.06 feet to a set 5/8" iron pin on the westerly right-of-way line of Roden Park Drive; Thence along the right-of-way line of said Roden Park Drive the following three (3) courses; 1. Containing 49.998 Acres of land and being subject to all rights-of-way, easements, encumbrances, covenants, restrictions and other matters of record. All monumentation called for as found is good condition unless otherwise noted. All monuments called to be set are 5/8" x 30" iron rebar with a yellow cap stamped "CESO", As recorded in Butler County Engineer's Record of Land Surveys in Volume 59, Page 68. Said Board will meet at 9:30 a.m. on July 22, 2019 in the Butler County Event Center, West Wing, Butler County Fairgrounds, 1715 Fairgrove Avenue, Hamilton, Ohio 45011, for the purpose of hearing such evidence. At such hearing may be presented any evidence for or against the proposed assessment and any competent evidence on the question of the benefits to be derived from the proposed ditch. Butler County will provide assistance to persons with disabilities needing interpreters or other auxiliary aids and services in order to participate in this hearing.
