Combined Notice of Finding of No Significant Impact and Notice of Intent to Request Release of Funds April 19, 2019 The City of Dayton, Ohio 101 W. Third Street, Dayton, Ohio 45402 (937) 333-3670 This Notice shall satisfy the above-cited two separate but related procedural notification requirements. REQUEST FOR RELEASE OF FUNDS On or about May 7, 2019, the City of Dayton, Ohio, as the responsible entity, through Todd Kinskey, Director of the Department of Planning and Community Development, will submit to the U.S. Department of Housing & Urban Development, a request for the release of Community Development Block Grant (CDBG) funds to undertake activities known as the Code Enforcement Nuisance Demolition 2017-18. Activities will take place within the City of Dayton, the County of Montgomery, and the State of Ohio, in multiple locations yet to be determined. The City will use these funds during the years 2019 through 2023. Program/ Year 2017 2018 Participant Number CDBG $1,235,000 - B-17-MC-39-0010 CDBG - $1,235,000 B-18-MC-39-0010 FINDING OF NO SIGNIFICANT IMPACT After performing a tiered review of the proposed activities, the City has determined that the projects will have no potentially adverse impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) (PL91-190) as amended, is not required. Additional project information is contained in the Environmental Review Record on file at the Department of Planning and Community Development, City of Dayton, 101 West Third Street, 6th floor. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments by mail to City of Dayton, Department of Planning & Community Development, 101 West Third Street, Dayton, Ohio, 45402. All comments received by May 5, 2019, will be considered by the City prior to authorizing a request for release of funds. Commentators should specify which part of this Notice they are addressing. RELEASE OF FUNDS The City certifies to HUD that Shelley Dickstein, in her official capacity as City Manager, consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and the City's certification received by May 22, 2019 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not, in fact, executed by the Certifying Officer or other officer of the City approved by HUD; or (b) the City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures in 24 CFR Part 58, and shall be addressed to HUD at their Columbus Area CPD office, located at 200 North High Street, Columbus, Ohio 43215; or to the Ohio Department of Development, 77 S. High St., PO Box 1001, Columbus, OH 43216-1001. Potential objectors should contact HUD to verify the actual last day of the objection period. 4-19/2019
