Case No. 2022 CV 04357, Leon Collins, et al., vs. Unknown spouse, heirs, devisees, legatees Executors, administrators, and assigns of Leona May Swackhamer aka Mary Leona May aka Rev. Leona May. Defendants Unknown spouse, heirs, devisees, legatees Executors, administrators, and assigns of Leona May Swackhamer aka Mary Leona May aka Rev. Leona May, whose places of residence are unknown and whom cannot be served within the State of Ohio, will take notice that on September 23, 2022, Leon Collins, et al., filed a Complaint as Plaintiff in the Court of Common Pleas of Montgomery County, Ohio, in Case No. 2022 CV 04357 against the above named Defendants alleging that the above named Defendants may have or may claim to have an interest in the deed restriction contained in Deed Vol. 2501, Page 5 and related to the real property located at 232 Hanna Avenue, Trotwood, Ohio 45427. The real property is more specifically described as follows: PARCEL NUMBERS H33300822-0036, 0037, and 0038; LEGAL DESCRIPTION: Situated in the City of Trotwood, fka Township of Madison, in the County of Montgomery and State of Ohio, and being Lots numbered One Hundred Fifty-Eight (158), One Hundred Fifty-Nine (159), and One Hundred Sixty (160), in what is known as Kingsville Park Subdivision fka Martha Frantz's Subdivision of 40 acres in Section 35, Town 4, Range 5 East, etc., as recorded in Plat Book G, Page 56 of the Plat Records of Montgomery County, Ohio. Defendants Unknown spouse, heirs, devisees, legatees Executors, administrators, and assigns of Leona May Swackhamer aka Mary Leona May aka Rev. Leona May, may have or may claim to have an interest indeed restriction relating to the above referenced property. Plaintiff seeks a finding from the Court declaring the deed restriction contained in Deed Vol. 2501, Page 5 be terminated and removed from the title to the above described real property as against the above named Defendants and in favor of Leon Collins and Jacquelyn Collins; an order requiring all defendants to set up their interests in the above described real property or be forever barred from asserting such interests and granting Plaintiffs all other relief, legal and equitable, as may be proper and necessary.
