LEGAL NOTICE IN THE COMMON PLEAS COURT OF MONTGOMERY COUNTY, OHIO, DAYTON, OHIO. CASE NO. 2019CV003547 CLIFFORD A. HURST, SANDRA R. HURST Plaintiffs vs. PAMELA S. SMITH-VANIMAN, ET AL Defendants John Doe, Names Unknown, whose last known address is 10 Elmore Street, Trotwood, OH 45426, are the unknown heir/heirs, children, issue or lineal descendants of James Lee Vaniman aka James L. Vaniman, whose identity and addresses are unknown and the unknown heirs, children, issue and/or lineal descendants who may claim an interest in the real estate set forth hereinafter in this Legal Notice, whose identity and addresses are unknown and cannot with reasonable diligence be ascertained, will take notice that on the 1st day of August, 2019, Clifford A. Hurst, et al, filed an action in the Common Pleas Court of Montgomery County, Ohio in Case No. 2019 CV 03547 demanding adverse possession and quiet title to the real estate hereinafter described. Said real estate is set forth as follows: Situate in the City of Trotwood, County of Montgomery, and in the State of Ohio and described as follows: BEING part of the N.W. quarter of Section 15, Town 4, Range 5 East, etc., bounded by beginning at a point in the west line of Pleasant Avenue in said City of Trotwood, 88 feet North of Rienzi R. Shank's (formerly Harry C. Mumma's) northeast corner and running from thence westwardly parallel with Rienzi R. Shank's and McFarland's (now Karns') north line, 125 feet more or less, to Theodore M. Wagner's east line; thence with said Wagner's east line northwardly 65 feet to a corner; thence eastwardly with said Rienzi R. Shank's and McFarland's (now Karns') north line 123.25 feet, more or less, to the west line of Pleasant Avenue; thence southwardly with said west line of Pleasant Avenue, 65 feet to the place of beginning. Containing 8103 ¾ square feet, more or less. Being the same premises conveyed by deed recorded in Book 2367, Page 577 of the Deed Records of Montgomery County, Ohio. Parcel I.D.#H33-003-04-0016,17 Deed reference: Deed-1998-0853E04 of the deed records of Montgomery County, Ohio. Any person claiming an interest in the subject real estate is required to file an Answer with the Clerk of the Montgomery County Common Pleas Court within twenty-eight {28) days of the date of the last publication of this service by publication or be forever barred from asserting any claims in and to said real estate. In the event that no claims are asserted in an Answer filed with the Clerk of Courts of the Common Pleas Court of Montgomery County, Ohio within such time frame, the Court will grant a default judgment ordering quiet title of the subject real estate to the Plaintiffs. All Defendants named above are further notified that they are required to answer the Complaint within twenty-eight {28) days after the last publication of this legal notice which shall be published once a week for six (6) consecutive weeks or judgment may be rendered as demanded against said Defendants and in favor of the Plaintiff.
