LEGAL NOTICE John A. Smitley whose last known place of residence was 2624 S. Kings Arm Circle, Dayton, OH 45459, but whose present place of residence is unknown, will take notice that on February 22, 2019, Fox Run Condominium Section II Homeowners Association, Inc. (the "Plaintiff") filed its Complaint in Case No. 2019 CV 00880 in the Court of Common Pleas Montgomery County, Ohio, 41 N. Perry St., Dayton, OH 45422, alleging that the Defendant, John A. Smitley, has, or claims to have, an interest in the real estate described below: Permanent Parcel Number: 068-50003 0033; Property Address: 2624 S. Kings Arm Circle, Dayton, OH 45459. The legal description may be obtained from the Montgomery County Auditor at 451 West Third Street, P.O. Box 972, Dayton, OH 45422, 937-225-4326. The Plaintiff further alleges that by reason of default of the Defendant in the payment of assessments, fees and other charges, required to be paid by the Condominium Documents, the Plaintiff is entitled to have the equity of redemption foreclosed and to have the property sold and the proceeds applied to the payment of the Plaintiff's judgement. The Plaintiff prays, that the Defendant(s) named above be required to answer and set up his/her/their interest in said real estate or be forever barred from asserting the same, for foreclosure of its liens, marshaling of all liens and the sale said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claims in the proper order of its priority, and for such other and further relief as is just and equitable.
