LEGAL NOTICE Warren County Common Pleas Court Kevin O'Sullivan, et al. v. John Doe and Jane Doe, Unknown Heirs, Next of Kin, Legatees, and Descendants of Susan L. Gillum and Her Unknown Spouse, and Their Unknown Spouses, if Any Case Number 20CV93499 Warren County Common Pleas Court Defendants John Doe and Jane Doe, the unknown heirs, legatees, next of kin, and descendants of Susan L. Gillum ( deceased), and her unknown spouse and their unknown spouses, if any, whose addresses are unknown and cannot with the exercise. of reasonable diligence be ascertained, will take notice that on the 4th day of August, 2020, Kevin O'Sullivan and Tina M. O'Sullivan filed their Complaint in the Common Pleas Court of Warren County, Ohio, in Case Number 20CV93499, on the docket of the Court and the object and demand for relief for which pleading is to quiet title against the above-named defendants, and for declaratory judgment, that the defendants named above have no interest in the following-described real estate: The following described tract or parcel of land situated in Sec. 14, T. 4, and Range 3, between the Miami Rivers in Union Township, Warren County, Ohio, and for the part herein described as follows: it being that portion of the Nathaniel Murphy Farm owned by James Murphy, lying and being West of the Center of the Miami Valley Railroad and containing eight acres of land, more or less, deeded to Mary Elizabeth Keever by James M. Murphy, by deed dated April 21, 1880, recorded in Vol. 59, at page 410, Deed Records of Warren County, Ohio. Said eight acre tract is bounded on the East by lands of Hayden Parris, and the C.L. & N. Ry. Co.; on the North by lands of John and Sylvester Perrine; on the South by lands of R.S. Hageman; on the West by lands of Theodore Hageman. LESS Situated in Union Township, Warren County, Ohio, and being part of Section #14-T 4-R3, between the Miami Rivers. Beginning at a point in the center line of the Lebanon and Cincinnati Pike, said beginning point being S. 38 deg. 40' E. 9.40 chains from the intersection of said Pike and the North line of said Section #14, running thence S. 48 deg. 40' E. 3.50 chains with the south line of the present roadway to the west right of way line of the C.L. & N. R.R.; thence with said right of way line N. 63 deg. 20' E. 35 feet; thence N. 48 deg. 40' W. 3.75 chains with the North line of the present roadway to a point in the center of the aforesaid pike; thence with said Pike S. 38 deg. 40' W. 34 feet to the place of beginning containing Eighteen hundredths of an acre. Said tract being the old roadway or outlet through and over the south side of the 8 acre tract conveyed by James M. Murphy to Mary Elizabeth Keever by deed dated Apr. 20, 1881 and recorded in Warren Co. Ohio Deed Record Vol. 59-page 410. Said tract being the old roadway or outlet used as a means on ingress and egress for the remainder of the said James M. Murphy lands lying East of said C.L. & N. R. R. as now owned by W. Hayden Parris. LESS Situate in Section Fourteen (14), Town Four (4), Range Three (3), between the Miami rivers in Union Township, County of Warren, and State of Ohio, and described as follows: Being that portion of the Nathaniel Murphy Farm that was owned by James Murphy lying and being east of the center line of State Route #42 and containing Eight (8) acres of land, more or less, deeded to Mary Elizabeth Keever by James M. Murphy by deed dated April 21, 1880, and recorded in Volume 59, Page 410, of the Warren County, Ohio, Records, said Eight (8) acre tract being bounded on the east by the right of way of the C L & N Railroad, on the north by the North line of Section Fourteen (14), Town Four (4), Range Three (3), on the west by the center line of State Route #4 2 and on the south by a roadway conveyed by Susan L. Gillum to W. Hayden Parris by deed executed August 10, 1934, and recorded in Deed Book 128, Page 584, of the Warren County, Ohio, Records. Defendants John Doe and Jane Doe, the unknown heirs, legatees, next of kin, and descendants of Susan L. Gillum ( deceased), and her unknown spouse and their unknown spouses, if any, addresses unknown, are required to answer within twenty-eight (28) days after the last date of publication of this notice, which shall be published once a week for six (6) consecutive weeks. In the event that Defendants John Doe and Jane Doe, the unknown heirs, legatees, next of kin, and descendants of Susan L. Gillum (deceased), and her unknown spouse and their unknown spouses, if any, addresses unknown, fail to respond in the allotted time,judgment by default can be entered against them for the relief requested in plaintiffs' Complaint.
