LEGAL NOTICE WAYNE WHITMILL, EXECUTOR OF THE ESTATE OF JOY WHITMILL Plaintiff vs. The Unknown widow, heirs, devisees, and next of kin of RICHARD CALVIN MOFFETT, aka Richard C. Moffett, all of whose names or addresses are unknown to Plaintiff and ALL OTHER JOHN OR JANE DOES or anyone else that may have contributed to, caused, or been involved in this matter either as corporations, partnerships, business associations, sole proprietorships, individuals, agents, or employees thereof, all of whose names or addresses are unknown to Plaintiff Defendants To the Defendants listed above, all of whose names or addresses are unknown to Plaintiff, you are hereby notified that you have been named as defendants in a legal action entitled Wayne Whitmill, Executor of the Estate of Joy Whitmill vs. The Unknown widow, heirs, devisees, and next of kin of Richard Calvin Moffett, aka Richard C. Moffett, et al Defendants. This action has been assigned case number 2019 CV 04714 and is pending in the Court of Common Pleas of Montgomery County, Ohio, 41 North Perry Street, Dayton, Ohio 45402. The object of the Amended Complaint is to reform a Deed of Executor recorded on September 10, 1997 as Deed 97-0614 E01 in the deed records of Montgomery County, Ohio for real estate described as follows: Situated in the Township of Washington, County of Montgomery and State of Ohio and being Unit 4 of Normandy Commons Condominium, as shown on the Condominium Declaration and Drawings recorded in Deed Records 75-593A01 and in Plat Book 99, Page 66 of the Plat Records of Montgomery County, Ohio, together with an undivided common ownership in the common areas and facilities as defined in the aforesaid Declaration of Condominium as an appurtenance to the above Unit. The Limited Common Area for the above described Unit is shown on the drawing that are attached to and made on exhibit to the Declaration of Condominium Ownership of Normandy Commons Condominium Parcel No. O67 50014 0004 Property Address: 405 Windsor Park Drive, Dayton, OH 45459 The defendants named above are required to answer the Amended Complaint within twenty-eight (28) days after the last publication of this legal notice. This legal notice will be published once a week for six (6) successive weeks. In case of your failure to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default will be rendered against you for the relief demanded in the Amended Complaint.
