NOTICE OF COMPLAINT LAND SALE ACTION REGARDING 1128 OSAGE AVENUE, DAYTON, OHIO 45419; MONTGOMERY COUNTY AUDITOR'S PARCEL NO. N64-00804-0131 CASE NUMBER 2019 MSC 00225 ELI T. SPERRY V. CAROL LACY, INCOMPETENT et al. The Unknown Persons Entitled to the Next Estate of Inheritance from Carol Lacy in the Real Property located at 1128 Osage Avenue, Dayton, Ohio 45419 Who are Known to Reside in Ohio; and All Individuals and Entities Claiming an Ownership Interest in, or Inchoate Lien or Other Encumbrance Upon, Vested or Inchoate Dower Rights in, or any Other Interests in the Real Estate Located at 1128 Osage Avenue, Dayton, Ohio 45419, Excepting Recorded Easements Rights will hereby take notice that on June 28, 2019, Eli T. Sperry, Plaintiff filed a Complaint in the Montgomery County, Ohio Common Pleas Court, Probate Division, 41 North Perry Street, Second Floor, Dayton, Ohio 45422, being Case No. 2019 MSC 00225 in said Court, against Carol Lacy, Incompetent, and others, specifically including all of the above noticed individuals, seeking a judicial declaration of authorization to sell the entire interest in the said real estate free of the claims, interests, liens, and rights of expectancy or dower therein of all persons to this action; further praying that said Defendants and all individuals claiming any interest in the premises and/or any lien or right therein be required to set forth any interest that said Defendants and individuals may have in said real estate, or be forever barred therefrom; that all judicial declarations and determinations in said proceedings be final and conclusive of the rights of all such parties and individuals with regards to the matters above referenced; and that the title of the referenced real estate be transferred in accordance with such declarations and determinations thereafter, as well as for such other and further relief to which the Plaintiff is or may be entitled. Said Defendants and individuals will take notice that they are required to answer said Complaint within twenty-eight (28) days after the date of the last publication of this notice, said answer date being the 15th day of November, 2019, or Judgment will be rendered as prayed for against any such non-answering Defendant or individual and the interest of said Defendants and individuals in said real estate will be terminated/barred.
