NOTICE OF SERVICE BY PUBLICATION IN THE COURT OF COMMON PLEAS, MONTGOMERY COUNTY, OHIO CITIZENS BANK, N.A., ETC. PLAINTIFF, VS. THE UNKNOWN SPOUSE, ETC., IF ANY, OF DORIS A. REYES, ET AL. DEFENDANTS. CASE NO. 2022 CV 01498 To the Defendants the unknown spouse, creditors, executors, executrices, administrators, heirs at law, next of kin, devises, legatees, and/or assigns, and their spouses, creditors, executors, executrices, administrators, heirs at law, next of kin, legatees, devisees, and/or assigns, if any, of Doris A. Reyes, whose present residence/ address is unknown and cannot with reasonable diligence be ascertained: Plaintiff has brought this action naming you as a defendant in the above-named Court by filing its amended Complaint on the 22nd day of June, 2022. The object of the Complaint is to foreclose the equity of redemption under one (1) mortgage against the following described real estate: Situated in the City of Dayton, County of Montgomery and State of Ohio: And being Lot Numbered Twenty Thousand Thirty-Four (20034) of the consecutive numbers of lots on the revised plat of the said City of Dayton, Ohio. Subject to all easements, conditions, restrictions, limitations of record and all legal highways and excepting from the warranty hereof taxes and assessments due and payable in June, 1972 and thereafter. Property Address: 111 Rockwood Avenue, Dayton, Ohio 45405 Parcel No. R72 06603 0021 And for a judgment upon one (1) promissory note executed to Plaintiff by Doris A. Reyes, now deceased. The relief demanded is a judgment against the subject real estate in the amount of $29,909.54 plus interest at the rate of 6.400% per annum from December 1, 2019, until paid, plus late fees; judgment for title costs, costs for protecting the real estate and for court costs; that said mortgages may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of plaintiff's claims; further that defendants be required to answer setting forth their claims or interests in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which plaintiff may be entitled. You are required to answer the Amended Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for 3 consecutive weeks, with the last publication to be made on the 11th day of July, 2022. In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Amended Complaint.
