COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Notice: November 17, 2022 Responsible Entity: City of Middletown, OH 1 Donham Plaza Middletown, OH 45042 REQUEST FOR RELEASE OF FUNDS On or about December 5, 2022, the Butler Metropolitan Housing Authority will request to the U.S. Department of Housing and Urban Development (HUD) for release of various funds to undertake the Rental Assistance Demonstration projects known as Middletown I and II. The following funds may be used for these activities. Capital Funds FY 2019 Capital Funds FY 2020 Capital Funds FY 2021 FY 15 Replacement Housing Fund FY 16 Replacement Housing Fund FY 17 Replacement Housing Fund Turnkey III FINDING OF NO SIGNIFICANT IMPACT The City of Middletown, Ohio has determined that the projects in its jurisdiction will have no significant impact on the human environment. Therefore, and Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. Additional project information is on file at the Butler Metropolitan Housing Authority, 4110 Hamilton Middletown Rd, Hamilton, Ohio 45011 and may be examined or copied Monday thru Thursday 8:00am to 4:30pm. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Butler Metropolitan Housing Authority, 4110 Hamilton Middletown Rd, Hamilton, Ohio 45011. All comments received by December 1, 2022, will be considered by the Butler Metropolitan Housing Authority prior to submission of a request for release of funds. Comments should specify which notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Middletown, Ohio certifies to HUD that Paul Lolli in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Butler Metropolitan Housing Authority to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the City of Middletown's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Middletown; (b) the City of Middletown has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at 1350 Euclid Avenue, Suite 500, Cleveland, Ohio 44115.
