NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS June 13, 2024 City of Dayton Ohio, 101 West Third Street, P.O. Box 22, Dayton, OH 45402; 937-333-3688; Beth.Wilson@Daytonohio.gov These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Dayton OH (City). REQUEST FOR RELEASE OF FUNDS On or about June 30, 2024 the City on behalf of Dayton Metropolitan Housing Authority will submit a request to HUD for the release of Capital Fund Program (CFP) and Project Based Voucher funds under Section 9(d) and section 30 of the U.S. Housing Act of 1937 (42 U.S.C. 1437g(d) and 1437z-2) and Section 8(o)(13) of the U.S. Housing Act of 1937 (42 U.S.C. 1437f(o)(13)); and Housing Opportunity Through Modernization Act of 2016 (Public Law 114-201) to undertake a project known as Desoto Bass Courts Redevelopment located at 1700 Germantown Street, Dayton, OH. The project will demolish 354 public housing units in phases and construct new housing units in phases, 44 units in this first phase, all units will be subsidized with Project Based Vouchers. The estimated project cost is $26,043,686 in various funding including but not limited to CFP, Housing Choice Voucher Rental Subsidy, Federal Housing Administration Loan Funding, Federal Home Loan Bank and private debt. FINDING OF NO SIGNIFICANT IMPACT The City has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Department of Planning, Neighborhoods, and Development, 101 West Third St., Dayton, OH, and may be examined or copied weekdays 8:00 A.M. to 5:00 P.M. The ERR is also available electronically, submit requests to: beth.wilson@daytonohio.gov. The ERR may be copied and examined online by following this link: https://cpd.hud.gov/cpd-public/ environmental-reviews PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR. Comments may be emailed to beth.wilson@daytonohio.gov or mailed to Beth Wilson, Department of Planning, Neighborhoods, and Development, 101 W. Third St, Dayton, OH, 45402. All comments received by midnight, June 29, 2024 will be considered by the City prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City certifies to HUD that Shelly Dickstein in her capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Dayton Metropolitan Housing Authority to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds and the City's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City (b) the City has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
