Watson Sr, have or claim to have an interest in the real estate described below: Situated in the State of Ohio, County of Montgomery and in the City of Dayton and further described as follows: Being 34.98 feet taken by parallel lines off the west side of Lot Number 32775 of the revised and consecutive numbers of lots on the plat of the said City of Dayton, Ohio, together with the grantor's right, title and interest in that part of a vacated fifty (50) foot street (vacated by City of Dayton Ordinance No. 17073 passed February 7, 1951) adjoining and abutting the southeast corner of the said lot. Premises commonly known as: 1432 Valley St, Dayton, OH 45404 Parcel No.: R72 05005 0009 The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute. The Plaintiff demands that the defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of plaintiff's claim in the proper order of its priority and for such other and further relief as is just and equitable.
