Case No. 2025 CV 03649 Judge Mary Montgomery PLAINTIFF'S NOTICE OF PUBLICATION Now comes Plaintiff Rayford Lewis, by and through counsel, and hereby request the court to grant Plaintiff to serve Defendant SK Racing LLC by publication. All attempts to serve Defendant have been exhausted. These include multiple attempts at service from the Court, FedEx and Certified Letters. S&K Racing, LLC , whose last known address is 5737 Webster Street., Dayton, Ohio 45414, otherwise whose address is unknown, will take notice that on June 3, 2025, the undersigned, Rayford Lewis, filed a complaint in the Court of Common Pleas, 41 N. Perry Street, Room 106, Dayton, OH 45422, of Montgomery County, Ohio, alleging that in 2023, Plaintiff was involved in a motorcycle accident after Defendant negligent repair work and/or the installation or failure to repair a defective component on the motorcycle. Defendants owed a duty to Plaintiff to ensure that the motorcycle and its components were reasonably safe for their intended use. Defendants owed Plaintiff a duty to exercise reasonable care in the inspection, repair, maintenance, and assembly of the motorcycle. Defendants breached that duty by failing to properly secure, inspect, or warn of the hazardous condition related to the wobbling and unstable handlebars. Such breach directly and proximately caused the wreck and Plaintiff's injuries. As a direct and proximate result thereof, the Plaintiff has suffered incidental, consequential, and compensatory damages, costs and expenses in an amount greater than Twenty-Five Thousand Dollars ($25,000.00), plus attorney's fees and costs; For such other relief as the Court deems just and proper. The defendants named above are required to answer within 28 days of service. This notice needs to be ran in the Dayton Daily News for six consecutive weeks.
