Priscilla Brown et al, Parcel No. R72-122-7-37 Priscilla Brown whose last known address was 575 Cedarhurst Ave., Unit 577, Dayton, OH 45402, will take notice that on the 16th day of April, 2025 Douglas Rindoria Nyakundi filed his Complaint for Abatement of Public Nuisance by Neighbor. This action pertains to property located at 575 577 Cedarhurst Ave., Dayton, OH 45402; Parcel No. R72-122-7-37. Situate in the City of Dayton, County of Montgomery and State of Ohio and being Lot Numbered FIFTY THOUSAND SEVEN HUNDRED NINETY-THREE (50,793) on the consecutive numbers of lots on the revised plat of City of Dayton, Ohio. Subject to all easements and restrictions of record on said premises. The building on this property is intended for residential purposes, however it is not occupied by Defendant or anyone else. The property is a public nuisance. There are no utility meters rendering the property uninhabitable. There is trash and debris in the yard. The roof and gutters need repaired or replaced. The property needs new electrical, plumbing, drywall, ceilings, flooring and HVAC systems. The property has been vacant for a significant period of time and no repairs have been attempted. Plaintiff Nyakundi has a viable financial and construction plan to abate the nuisance and make the building habitable. Plaintiff is requesting the Court declare the building a public nuisance, that the Court accepts Plaintiff's plan to abate the public nuisance, that upon completion of the plan the Court authorizes Plaintiff to offer the property for sale and to accept a commercially reasonable price. Following the sale of the property the Court confirms the sale and direct payment of the proceed in accordance with ORC 3767.41(I)(3) and all other relief as may be proper. Defendant Priscilla Brown is required to answer or respond within 28 days after the publication or at such time after publication that is set as the time to appear or within which to respond after service of such pleading or other document.
