NOTICE OF SERVICE BY PUBLICATION IN THE COURT OF COMMON PLEAS, MONTGOMERY COUNTY, OHIO CITIZENS BANK, NA PLAINTIFF, VS. ANDY ELMS, ET AL. DEFENDANTS. CASE NO. 2025 CV 03803 To the Defendants Andy Elms and the unknown spouse, if any, of Andy Elms, whose last known address is 521 Kenilworth Avenue, Dayton, Ohio 45405, whose present residence / address is unknown and cannot with reasonable diligence be ascertained: Plaintiff has brought this action naming you as a defendant in the above-named Court by filing its Supplemental Complaint on the 23rd day of October, 2025. The object of the Supplemental Complaint is to foreclose the equity of redemption under one (1) mortgage against the following described real estate: Property Address: 521 Kenilworth Avenue, Dayton, Ohio 45405 Parcel No. R72069030010 And for a judgment upon one (1) credit line agreement executed to Plaintiff by Andy Elms. The relief demanded is a judgment against the subject real estate in the amount of $27,521.84 plus interest at the rate of 10.250% per annum from November 26, 2024 and at the rate of 9.750% (variable) per annum from June 4, 2025, until paid, plus late fees; judgment for title costs, costs for protecting the real estate and for court costs; that said mortgages may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of plaintiff's claims; further that defendants be required to answer setting forth their claims or interests in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which plaintiff may be entitled. You are required to answer the Supplemental Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for 3 consecutive weeks, with the last publication to be made on the 12th day of November, 2025. In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Supplemental Complaint.
