DILLARD HOWARD'S consent is not required as he has knowingly failed without justifiable cause to communicate significantly with the child when able to do so or failed to provide for the care and support of the child when able to do so as required by law or judicial decrees for a period of at least one year (Ind. Code §31-19-9-8(a)(2)). If DILLARD HOWARD seeks to contest the adoption of the child, DILLARD HOWARD must file a motion to conest the adoption in accordance with Ind. Code §31-19-10-1 in the above named court not later than thirty days after the date of service of this notice. If DILLARD HOWARD does not file a motion to contest the adoption within thirty days after service of this notice the above-named court will hear and determine the petition for adoption. The consent to adoption of DILLARD HOWARD will be irrevocably implied and DILLARD HOWARD will lose the right to contest either the adoption or the validity of DILLARD HOWARD'S implied consent to the adoption.
