Ph: 614-644-3037 email: HClerk@epa.ohio.gov VAP Covenant Not to Sue Issuance / Denial / Revocation / Amendment-Final Findings and Orders Butler/High/MLK City Parking Lot 400 High Street, Hamilton, OH 45011 Date of Action: 06/25/2026 Notice is hereby given that on June 25, 2026, the Director of the Ohio Environmental Protection Agency ("Ohio EPA"), pursuant to Ohio Revised Code ("ORC") Chapter 3746 and Ohio Administrative Code ("OAC") Chapter 3745-300, issued a Covenant Not To Sue/Final Findings and Orders to the City of Hamilton, the "Volunteer" and "Owner" for property known as Butler/High/MLK City Parking Lot (the "Property"). The Volunteer conducted a voluntary action of the approximately 2.719 acre-Property, which is located at 400 High St, Hamilton, Butler County, Ohio. A no further action letter for the Property was submitted on September 8, 2025, to the Voluntary Action Program of the Ohio EPA Division of Environmental Response and Revitalization by Paul Kuonen, a Certified Professional as defined in ORC 3746.01(F) and OAC 3745-300-01(A). 7-6/2026
