LEGAL NOTICE IN THE COMMON PLEAS COURT OF MONTGOMERY COUNTY, OHIO, CIVIL DIVISION, IN THE MATTER OF CITY OF WEST CARROLLTON, OHIO vs. DONNA JEAN RICHARDS, et al., CASE NO. 2026 CV 03038 FILED ON MAY 19, 2026. TO THE UNKNOWN HEIRS, NEXT OF KIN, LEGATEES, AND DEVISEES OF ANNA E. MOUNT AND THE UNKNOWN EXECUTOR/ADMINISTRATOR OF HER ESTATE: The aforementioned persons shall take notice that Petitioner City of West Carrollton, Ohio ("West Carrollton") filed its Petition for Appropriation (the "Petition") in Case No. 2026 CV 03038 with the Montgomery County Common Pleas Clerk of Courts, located at the Montgomery County Courts Building, 41 N. Perry Street, Dayton, Ohio 45402, seeking to appropriate property owned by decedent Anna E. Mount (born 1888; died 1969) for the purpose of making public road improvements on Crossover Street in West Carrollton, Ohio. The City's Petition alleges that Respondents Unknown Heirs, Next of Kin, Legatees, and Devisees of Anna E. Mount and the Unknown Executor/Administrator of her Estate may have or claim an interest in the real estate located on Crossover Street, in West Carrollton, Ohio, Parcel ID: K48 00509 0023 (the "Property"). By Resolution No. 23-2026, adopted on April 14, 2026, West Carrollton City Council declared its intention to appropriate a fee simple interest in the Property for the purpose of making public road improvements, of which notice of the Resolution was given according to law. Thereafter, by Ordinance No. 3831, passed on April 28, 2026, West Carrollton's City Council appropriated the Property; determined the fair market value of the Property to be $65,340.00, as determined by an independent, certified appraiser; and authorized and directed the City Law Director to petition the Montgomery County Common Pleas Court to assess the compensation to be paid for the Property. The Unknown Heirs, Next of Kin, Legatees, and Devisees of Anna E. Mount and the Unknown Executor / Administrator of her Estate (collectively, "Respondents") have 28 days from the date of the last publication of this Legal Notice to file an Answer in response to West Carrollton's Petition. This Legal Notice shall be published once per week for two consecutive weeks with the last date of publication being June 15, 2026. Respondents shall take notice that failure to timely answer the Petition can result in the court declaring the value of the Property as set forth in the City's Petition and/or any interest you have or claim to have in the Property being forever barred.
